This additional privacy notice is for residents of U.S. States that have enacted comprehensive laws governing the use of personal information (“U.S. State Privacy Laws”). These laws, among other things, (a) give residents certain rights to control how their personal information is used by businesses, and (b) require businesses to disclose how they handle personal data and implement mechanisms to enable individuals to exercise their data privacy rights.
This notice supplements the transparency information in the Motorola Mobility Website Privacy Statement which includes: what personal information, including any sensitive personal information, is collected; the source of the personal information; the business and commercial purposes of use; and how long the information is retained. In particular, the following sections provide useful background information about how Motorola uses personal information for advertising purposes:
Motorola does not have actual knowledge that it sells personal information, shares for cross-context behavioral advertising purposes, or processes for targeted advertising purposes the personal information of consumers under 16 years of age; or that it collects or processes the personal information of consumers under 13 years of age.
Some U.S. State Privacy Laws classify businesses that use personal information to target advertisements as third parties, even though those businesses are subject to contract terms with Motorola that severely limit the businesses’ rights to use and retain the information that Motorola shares with them. In the preceding 12 months, Motorola has shared to advertisers, ad networks, advertising partners, social media networks, and advertising measurement providers, pursuant to written contracts that contain terms required by U.S. State Privacy Laws, the following categories of personal information:
A. Identifiers including, device identifiers, advertising identifiers, IP addresses, browser cookies, and other unique online identifiers
B. Internet activity information including data about a consumer’s interaction with an Internet website, application, service, or advertisement
C. User Profile information including email address and general location information
D. Inferences drawn from Personal Information, including preferences, interests, and other data used to personalize a consumer’s experience
Categories A through D are each shared with the third parties identified above and processed by Motorola for cross contextual behavioral advertising purposes, for targeted advertising purposes, to target ads, and to provide analytics and reporting related to the effectiveness of advertising.
Some U.S. State Privacy Laws grant consumers certain rights regarding their personal information. We honor requests in accordance with and to the extent required by applicable laws, which may vary depending on where you live. Depending on your state of residence, your rights may include:
You can submit a request to exercise the rights applicable to you through our Privacy Request Form or by contacting Motorola at privacy@motorola.com. Motorola does not discriminate in response to privacy rights requests. We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations. You may also use an authorized agent to submit a privacy request form on your behalf. If you do so, Motorola will require: (i) you to provide the authorized agent written permission to do so; and (ii) your agent to verify their identity directly with Motorola. Motorola may deny a request from an agent that does not meet these requirements.
In an increasing number of U.S. States, you can request that Motorola not: (a) sell your personal information, (b) share it with third parties for cross-context behavioral advertising purposes, or (c) process it for targeted advertising purposes.
